A judge denies Sidney Powell’s request to dismiss her Georgia election interference case

A judge on Thursday rejected former Trump campaign lawyer Sidney Powell’s request to dismiss the Georgia election interference case against her over allegations of prosecutorial misconduct.

The ruling, issued after a hearing in Fulton County, comes weeks before Powell is scheduled to go on trial alongside Kenneth Chesebro after both requested a speedy trial in the case.

“On procedural grounds alone, I do not think that a motion to dismiss for misconduct … made it clear that a procedural barrier was within the court’s jurisdiction,” Judge Scott McAfee said.

Powell, Chesebro and 17 others, including former President Donald Trump, pleaded not guilty in August to all charges in a wide-ranging racketeering indictment for allegedly trying to overturn the results of the 2020 presidential election in Georgia. Defendant Scott Hall then agreed to a plea deal in which he pleaded guilty to tampering with voting equipment.

Powell’s attorney adamantly maintains that Powell was not involved in the breach of voting machine security in Coffee County, as alleged in the charges against her.

“I think it’s safe to say that both sides believe strongly in the strength of their cases,” McAfee said. “When two sides believe it… that’s why we have our jury trial system.”

The trial is scheduled to start on October 23.
