A man arrested for murdering an Amazon driver has left prison with a suspended sentence

CHESTERFIELD COUNTY, Va. – A man is now in custody and charged with murdering Amazon delivery driver Chelsea Johnson on Friday night outside a Chesterfield warehouse, police said.

CBS 6 confirmed that Johnson and murder suspect Darryl M. Charity Jr. they lived together in Richmond.

Chesterfield police responded to a shooting near a warehouse on Bellwood Road Friday night around 9:30 p.m. There she found 33-year-old Johnson suffering from a gunshot wound. She died on the spot.

Johnson’s sister, Yoland Robertson, shared photos of her sister with CBS 6.

“How do you describe her life to someone who has never met her?” Robertson said in a statement. “In 7 words: the best sister you could ever ask for.”

She said Johnson was “a caring mother, a fool and a fighter.”

Charity Jr., 31, was arrested Saturday and charged with second-degree murder, use of a firearm in the commission of a felony and possession of a firearm by a convicted felon. He was booked into the Chesterfield County Jail without bond.

“The fact that he was charged with a second-degree charge, I don’t think it suggests that they think it’s just a second-degree charge. This could easily be increased in the future,” said Todd Stone, legal analyst for CBS 6. “The goal of second-degree murder charges right now is to catch them, keep them in jail and continue the investigation without creating such a risk to the public.”

Stone said second-degree murder charges are considered the “default level” of a murder charge in Virginia.

“But in domestic cases they are all always a little bit special because sometimes there are text messages, phone messages, there are notes that someone can write to another, sometimes in a domestic case it is easier to show motive because both people knew each other and maybe there will be something to do for the police,” Stone said.

Court records show that last year Charity Jr. She pleaded guilty to committing a drug offense and was sentenced to 10 years in prison.

The entire sentence was suspended.

Stone said it’s not uncommon, but it could play a role in this case.

“In the case of a time-served suspension, they can ‘show cause,’ and therefore they can ask for part of the suspension to be lifted based on the new conduct,” Stone said. “They still need to establish whether he committed this offense or whether he breached the terms of his suspended sentence. However, this is another potential offense that he may face.”
