Child Sexual Abuse Accountability in Los Angeles County

Sexual abuse in schools is unfortunately very common. According to not today“in 2017-2018, there were 14,938 cases of sexual violence in primary and secondary schools, compared to 9,649 in 2015-2016, an increase of 55%. These include cases of rape or attempted rape and sexual assault.” Schools should take a number of measures to prevent sexual abuse of students.

  • Schools may introduce controlled entry and exit points to limit the number of people allowed to enter the school.
  • Schools should install and maintain surveillance cameras.
  • Schools should conduct background checks on all third parties who have contact with students.

All schools have a legal duty to protect students from reasonably foreseeable sources of harm. This includes assaults by third parties. Consider, for example: Leger v. Stockton Unified School District. (1988) 202 Cal. App. 3d 1448. The California Court of Appeals considered a case in which a student was assaulted by a nonstudent in a school restroom. The student’s attorneys argued that the school failed to protect the minor plaintiff from the attack. This was true even though they knew or should have known that the restroom was dangerous and that attacks would likely occur. It is important to take specific steps following sexual abuse in a school setting.

  • A police report should be prepared about the incident.
  • Medical records related to the assault must be kept.
  • Eyewitnesses should be interviewed.
  • You should contact an experienced school sexual violence attorney.

Sexual abuse is one of the most traumatic and devastating events that children can experience. Victims are often left with long-term trauma and are at greater risk for chronic health problems. Unfortunately, schools often do everything in their power to deny responsibility if a child in their care is sexually abused. That is why it is so important to seek the advice of an experienced attorney. A child sexual abuse attorney can review all of the unique facts of your case and advise you on your legal options.
