After Bannon was convicted, Nichols agreed to a suspended prison sentence while Bannon appealed the verdict.

He ordered Bannon to report to prison after the D.C. Circuit Court of Appeals upheld Bannon’s conviction last month.

Last Friday, Bannon filed a motion for an emergency appeal with the U.S. Supreme Court in an attempt to avoid a prison sentence.

The Supreme Court did not provide any breakdown of votes in its decision to deny his request.
