The judge in Kevin Costner and Christine Baumgartner’s divorce case on Wednesday temporarily extended the actor’s $129,755 monthly alimony payments.

The judge also denied it Yellowstone a motion by star’s lawyers to settle the issue of alimony before the date of a hearing to determine the validity of challenging the couple’s prenuptial agreement of November 27.

Costner’s attorneys also asked for 10 days to review the auditor’s final filings before trial on both the child support agreement and the prenuptial agreement because nearly 9,000 pages of the auditor’s documents have been collected so far.

Legal documents filed by the actor’s lawyers show that Baumgartner could be forced to forfeit her $1.5 million divorce settlement for challenging the prenup.

“If Christine challenges in any way, or assists in challenging, the validity or enforceability of any provision of this Agreement, she shall forfeit any right to receive any payment, Property or Interest from Kevin pursuant to this Agreement,” according to the agreement, which the Oscar winner’s lawyers cited in legal documents filed June 28.

Marilyn Chinitz, a matrimonial attorney at Blank Rome in New York (she does not represent either Costner), told PEOPLE at the time that such clauses in prenuptial agreements are quite common. “Lawyers call these provisions ‘in torrer’ because it is a clause designed to instill fear. They encourage someone to question the contract.”

Chinitz added: “What this basically means is, ‘If you are going to challenge the contract by finding it invalid and unenforceable, then I have the right to recover everything you could have benefited from.’”
