D.C. Superior Court Judge Heidi Pasichow granted defense counsel’s request that his client be given more time to consider a plea deal while awaiting crime scene footage.

Darius Thomas, 27, is charged with unlawful possession of a firearm with a conviction of more than one year, carrying a pistol without a license outside a home or business, possession of an unregistered firearm and unlawful possession of ammunition for his alleged involvement in a nonfatal shooting that occurred March 25 in the 3700 block of 10th Street NW.

During a June 28 hearing, defense attorney John Machado asked Judge Pasichow to set a date for Raymond Elementary School to produce subpoenaed surveillance footage of the incident. The school is located at 900 Spring Road NW, near the shooting scene.

The school did not respond to the subpoena, which Judge Pasichow agreed to address at the next hearing.

Machado also asked the court to set a return date so it can take action if the school fails to comply.

Arrest documents show that a witness at the scene told Metropolitan Police Department (MPD) officers responding to a report of the shooting that the alleged shooter got into a white Acura SUV with two unidentified people. Police stopped the vehicle and allegedly found Thomas carrying a handgun in his jacket pocket.

Court documents say the scene was near a recreational facility where school-age children were staying.

The sites are scheduled to return on August 2.
