Lawyers oppose ‘communication’ asking judges not to issue final orders during vacation | Delhi News

On Tuesday, lawyers associated with the organization met with a district judge and raised objections to alleged internal administrative correspondence that urged temporary first-instance court judges not to issue final rulings in pending cases during a break in court.

Delhi Lawyers’ Association, headed by advocate Sanjeev Nasiar, who is also the chief of the Aam Aadmi Party (AAP) legal wing, has written a letter to the district judge in this regard. The letter assumes significance as it was sent after Chief Minister Arvind Kejriwal was granted bail by vacation judge Nyaya Bindu on June 20 in a money laundering case related to an alleged excise scam.

The bail order was later stayed by the Delhi High Court on an appeal by the Enforcement Directorate (ED). District courts in Delhi were closed for summer vacation from June 10 to June 29. During this period, judicial officers take turns as vacation judges.

The lawyers’ body claimed that an administrative order had been issued directing the vacation judges not to issue any significant orders in cases during their vacations. However, the lawyers’ body did not make any such administrative order available to the media.

“It is known that Justice Nyaya Bindu had granted bail to Delhi Chief Minister Arvind Kejriwal on June 20…. However, several advocates have complained that soon after the order was passed, the District Judge of Rouse Avenue Court passed an internal administrative order directing all the benches sitting on leave not to pass any final orders in any case and only issue notices to the regular benches sitting on leave,” the letter said. It alleged that such an order was not only “administratively and procedurally irregular but also a travesty of justice”.

“The whole purpose of the rest benches is that there are urgent matters that require attention even during the holidays, and issuing such an administrative order would defeat the very purpose of the rest benches,” the letter reads.
