Gujarat CID top cop gets bail but is suspended from service | Ahmedabad News

Gujarat CID (Crime) chief Nita Chaudhary, who was arrested on Monday along with a liquor smuggler for allegedly trying to run over pursuing policemen, was granted bail by a court in Kutch’s Bhachau on Wednesday, but has been suspended from her duties by the state home department.

However, before she could leave the jail, the Bhachau police initiated custody proceedings against her in a case filed under the Gujarat Prohibition Act.

According to FIR registered at Bhachau Police Stationon Sunday evening, Chaudhary and “smuggler” Yuvrajsinh Jadeja — a resident of Juni Moti Chirai village near Bhachau town — allegedly tried to run over six policemen in their Thar car, which had no number plate. The two were arrested on National Highway 41 near Bhachau town.

The police seized 16 bottles of liquor and two cans of beer from the car – worth a total of Rs 1,880 – which Jadeja stopped only after Dineshkumar Zala, sub-inspector of the Bhachau police station, fired shots at them.

Based on a complaint filed by Zala, the two were booked on Sunday under sections 307 (attempt to murder), 427 (intentionally causing hurt to the extent of fifty rupees) and 114 (presence of abettor in the commission of an offence) of the Indian Penal Code.

Based on a complaint filed by police officer Mohan Sonar, who accompanied Zala, another offence under the Prohibition Act was registered against two persons. “We are in the process of arresting these two persons in connection with the prohibition case,” said Kutch East Police SP Sagar Bagmar.

Meanwhile, the Thar driven by Jadeja did not have a registration number, the registration certificate recovered from the car showed that the vehicle was registered in the name of a local journalist in Gandhidham. “The policeman claims that Limbachiya is her friend,” the officer said.

“During interrogation, Chaudhary said that she and Yuvrajsinh had interacted through Instagram and Facebook around six months ago and became friends. It is possible that she was initially unaware of Yuvrajsinh’s criminal past. But it is unbelievable that she might not have been aware of Yuvrajsinh’s illegal activities after interacting with him,” the officer said.

Speaking to The Indian Express, Chaudhary’s lawyer Dilip Joshi Chaudhary said that the policeman had on Wednesday approached the court of Bhachau Additional Chief Judicial Magistrate DS Dabhi seeking bail in the attempt to murder case, which the court accepted.

“We informed the court that the same court on Tuesday had rejected the police plea seeking her remand as it found no justifiable grounds for her remand. We said that since there was no need to question her in custody, the petitioner, being a woman, should be enhanced on bail under Section 437 of the CrPC, which empowers the lower court to grant bail to minors, women and infirm persons, among others, even in non-bailable offences. The court agreed to our plea and granted bail to Chaudhary.”

Earlier, 16 cases were registered against Jadeja at the Bhachau police station and he is wanted in four of them.
