Man convicted of causing death of Fountain police officer appears in court

COLORADO SPRINGS — A hearing was held Wednesday for the man convicted in the February 2023 death of a Fountain police officer. The hearing was to determine whether Devon Bobian is a repeat offender, which could lengthen his sentence.

At the regular hearing, an investigator from the district attorney’s office spoke about Bobian’s four prior felonies: robbery, two counts of possession of a firearm by previous offenders and possession of a controlled substance with intent to distribute.

He also compared the fingerprints from the Fountain case with those found in Bobian’s other cases and found them to be the same.

In May, Bobian was found guilty of second-degree murder, aggravated robbery, uttering threats, fleeing in a vehicle, first-degree aggravated theft of a vehicle and being a habitual offender.

In February 2023, Bobian was in a stolen car stopped by police on the South Academy Boulevard Bridge near I-25. Investigators say Bobian jumped onto the police car and made a threatening gesture toward Officer Julian Becerra.

This caused Becerra to fall backward and forty feet off the bridge. He died nine days later in the hospital.

In court on Wednesday, the defense questioned the quality of the fingerprint evidence, but the judge ruled that the evidence presented by the court showed that the individuals had met their burden of proof and established that all four offences for which Bobian was convicted were related to the same crime.

The next step is a proportionality review, which is scheduled for September. Then there will be a sentencing, where families and those affected will have a chance to have their say.

Bobian’s sister was at the hearing on Wednesday. She spoke to me and said that the situation was very frustrating for her and that her brother was not the monster they thought he was.

Bobian remains in custody.
