District Judge Rules Against Legal Marijuana in Massachusetts – President’s Prayer Team

He argues that marijuana companies would have grounds to sue if the case goes to the Supreme Court.

District Judge Mark Mastroianni rejected the Massachusetts marijuana companies’ arguments, saying a previous Supreme Court decision prevented them from forcing marijuana legalization in the state through the court system. The companies tried to circumvent the Supreme Court ruling by showing how the scientific understanding of marijuana use has changed dramatically in two decades, but the court said scientific findings do not supersede legal rulings.

However, Judge Mastroianni did not reject the companies’ right to sue, suggesting in his order that their argument could be compelling if they succeeded in getting the Supreme Court to overturn its own 2005 decision. Gonzales vs Raich.

In the order, he wrote: “Only the Supreme Court may reverse its own decisions, and lower courts must apply directly applicable precedent, even if there is reason to believe that that precedent has been overturned by subsequent events.”
